LIABILITY WAIVER, PROMOTION RELEASE AND
EMERGENCY CONTACT FORM

I hereby acknowledge that I have voluntarily been invited to participate in activities or events which are sponsored, authorized or run by WisePause Wellness, Tea Botanics and/or Skirball Cultural Center hereinafter referred to “WPWL”, “TB” and “Skirball”, respectively. These events and activities may include but are not limited to the following: training or instruction, meetings and all activities and functions of any kind or manner which are sponsored, operated, managed or promoted by WPWL, TB and Skirball.


1. Food Sampling: I am aware that food tasting will be offered at the event and that it is my responsibility to ask about ingredients in all food tasting I chose to participate in. I acknowledge and understand the WARNING (that in the preparation of said samples or foods, items may be used which could cause an allergic reaction) concerning the risks of known and unknown food allergies. It is my responsibility to inquire about the ingredients before sampling and such items or foods.
2. Indemnification: In consideration of being permitted by WPLT, TB and Skirball to participate in the activities and functions of the event, the UNDERSIGNED AGREES TO RELEASE, DEFEND WPLT, TB, Toyota, and any of their affiliated organizations, subsidiaries, insurers, officers, directors, shareholders, employees, agents and volunteers (each hereinafter “RELEASED PARTIES”) from ANY AND ALL LIABILITY and/or claims arising from injury or death to persons or damage to property arising from my participation in the activities.

3. Promotional Use: I irrevocably grant WPWL and TB without any compensation being due to me, the right of publicity (including but not limited to print, radio, television, and web promotions), resale and the right to own, copyright and use any representation of me (with or without captions or credit), audio and/or visual, in any medium (including film, videotape and/or still photographs) while attending and or participating in any activity sponsored, operated, managed or promoted by WisePause Wellness Live!

I represent and warrant to the best of my knowledge that my acts and statements contained in the Material will not violate any right of any other person or company and that I have full right and authority to grant the rights herein with respect to any and all original material (including any literary or musical works) submitted or performed by me hereunder.

I understand that TB will own all rights to the Event and/or Program and WisePause Wellness Live! Material, and will have the right to broadcast, distribute, exhibit, promote and advertise the Event and/or Program and the WisePause Lifestyle Tour Material in any and all media, whether now known or hereafter developed, including, without limitation, electronic media and the world wide web, worldwide and in perpetuity in such manner, in part or in whole, as TB, may determine in its sole discretion.

I expressly agree that the foregoing release agreement is intended to be as broad and as inclusive as is permitted by the laws of the State of California and that if any portion of it is held invalid, it is agreed that the balance shall notwithstanding continue in full legal force and effect. I further agree that ANY AND ALL CLAIMS for injury and/or death arising from my participation in the activities shall be GOVERNED BY CALIFORNIA LAW and any claim shall be in the DISTRICT COURT where the alleged incident occurred or in the FEDERAL COURT FOR THE STATE OF CALIFORNIA.

(I hereby acknowledge that my association with TSP does not in any way include or guarantee to me any insurance coverage of any kind.)

1. I authorize any RELEASED PARTIES and/or their authorized personnel to call for medical care for the participant or to transport the participant to a medical facility or hospital if, in the opinion of such personnel, medical attention is needed. I further agree that upon transport to any such medical facility, WPLT, TB and/or Skirball will have no further responsibility to me and will not be responsible for any costs associated with treatment received by me or the participant.

In accordance with California state and local guidelines and public health guidance, proof of full vaccination for entry in all WisePause Wellness venues is preferred with a valid ID.

1. I understand that this event shall be presented in accordance with applicable public health conditions as of the date of the event and which may change at any time as determined by federal, state or local government agencies or instrumentalities, artists or the promoter; such requirements may include, without limitation, changes to capacity, attendance procedures and entry requirements, such as proof of vaccination, and other protective measures such as requiring attendees to wear face coverings when inside venues.

2. I agree to follow summit policies (including health and safety policies) and posted instructions while at the summit. According to the CDC, older adults and people of all ages with serious underlying medical conditions may be at higher risk of death or severe illness from COVID-19. All attendees should evaluate their risk in determining whether to attend the summit. By entering the summit, attendees voluntarily assume all risks related to exposure to COVID-19 and confirm that they will adhere to local quarantine mandates and the CDC quarantine requirements, available at https://www.cdc.gov/coronavirus/2019-ncov/if-you-are-sick/quarantine.html.

I HAVE CAREFULLY READ THE FOREGOING LIABILITY RELEASE, UNDERSTAND ITS CONTENTS, AND AM AWARE THAT I AM RELEASING CERTAIN LEGAL RIGHTS THAT I MAY HAVE.
